The entire contents of the Site are protected by international copyright and trademark laws. The owner of the copyrights and trademarks is Paul Jaruszewski, his affiliates or other third party licensors.
You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute, in any manner, the material on the site, including text, graphics, code and/or software. You may print and download portions of material from the different areas of the site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials.
2. Limitation of Liability:
In no event will Paul Jaruszewski be liable for:
(i) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the service, or any information, or transactions provided on the service, or downloaded from the service, or any delay of such information or service. Even if Paul Jaruszewski or its authorized representatives have been advised of the possibility of such damages, or
(ii) any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the service. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such states, Paul Jaruszewski’s liability is limited to the greatest extent permitted by law.
I accept no liability, implied, or otherwise, should the use of our products or services cause downtime, loss of earnings or any other negative impacts. I will be more than happy to offer support and assistance where possible to resolve any issues your installation may have. However, it is you responsibility to ensure that you always have a backup of your computer files, databases and other information before making any changes.
3. Indemnification:
You agree to indemnify, defend and hold harmless Paul Jaruszewski from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.
4. Miscellaneous:
Every Photoshop Action and Excel spreadsheet has been tested to make sure that it works seamlessly with an average Photoshop and Excel installation. However, because there are many variations of operating systems, configurations and software versions I cannot guarantee my products to work with all installations. I will work with all users who experience problems to provide the functionality expected in the software.
5. Liability:
I accept no responsibility for any damage or loss of earnings to your computer / data in any instance when using my products. It is your responsibility to keep a regular backup of your photos and relevant files so that if the worst does happen, you can use your backup to restore your photos and data.
6. Refunds:
Due to the nature of the products I sell, refunds will not be issued to consumers based on satisfaction of the features. I have tried to provide enough documentation and working demonstration of the products. If you feel that a demonstration does not answer your question or provide you with the information that you need, please don’t hesitate to contact me.
7. Software License:
A product with an individual license is one that is permitted to be installed on a single computer by a hobbyist or non-professional. A site / professional license is one that is to be used in a commercial or professional environment or on more than one computer.
8. Privacy Policy:
All details obtained during registration, ordering or other activity on my site are held with the strictest confidence. We will never sell or give your information to any external companies or sites.
9. Security:
You are prohibited from using any services or facilities provided in connection with this site to compromise security or tamper with system resources and/or files. The use or distribution of tools designed for compromising security (e.g., password guessing programs, cracking tools or network probing tools) is strictly prohibited. If you become involved in any violation of system security, Paul Jaruszewski reserves the right to release your details to system administrators at other sites in order to assist them in resolving security incidents. Paul Jaruszewski reserves the right to investigate suspected violations of these Terms of Use.
